Can you guarantee my ticket will be dismissed?
No! In fact, no company can offer a guarantee. Paralegals are regulated by the Law Society of Ontario and as such a guarantee cannot be offered. Be cautious of any company that is offering any promises or guarantees as these offers are contrary to current regulations.
The fine on my ticket is not much, should I just pay the fine?
The fine amount listed on a traffic ticket is NOT the only penalty you could be facing. Once you pay the fine on a traffic ticket, you are pleading guilty to the offence along with all of associated penalties which may include demerit points, licence suspensions and potentially jail time.
Is the officer REQUIRED to show me the radar/laser device reading?
NO. It is up to the discretion of the officer to decide whether or not to show you the reading.
How much time do I have to decide on my options when I receive a traffic ticket ?
You have 15 days from the date of the offence, noted at the top of your ticket.
How long will demerit points stay on my driving record?
Demerit points remain on your record for 2 years from the date of offence.
How long will a conviction stay on my driving record?
A conviction will remain on your record for 3 years from the date of conviction.
Is it true if the officer does not show up in court my ticket will automatically be dismissed?
Not necessarily...The Justice of the Peace may grant the prosecutor an adjournment for a FURTHER court date if the officer has a valid reason for not attending.
If I hire you, do I need to attend court?
If you retain a paralegal for your traffic ticket, you do NOT need to attend court as an agent will attend on your behalf. However depending on the nature of your case, there may be occasions where your presence will be beneficial to the outcome of your case.
Will my ticket be automatically dismissed if my name is spelt wrong?
Not necessarily. The courts have the power to amend this type of error. Unless the name on your ticket is almost completely wrong, more likely than not, it will be amended.
Will my insurance go up if I get a ticket?
Traffic ticket convictions remain on your driving record for 3 years from the date of conviction! Your insurance company can review your driving record at any time and see these offences.
I was issued a ticket for failing to move for emergency vehicle what was I supposed to do?
You are required to slow down and move over for both emergency vehicles and ALSO for tow trucks.
What are the chances that my traffic ticket will be dismissed?
Upon being issued a traffic ticket, it is difficult for a paralegal to know what the exact outcome of your traffic ticket matter will be since every case is different. We will have to order the officer’s notes (disclosure). Disclosure is the evidence the prosecutor will have against you and is needed in order to see what kind of defence we can build. It is difficult to make an educated guess as to the outcome of your case without having all the necessary details and evidence.
